[ARCHIVED] Magistrate Court Releases Common Fine & Court Cost Schedule

MARTINSBURG, W.Va. - Due to the number of in-court proceedings, magistrates are unable to accept telephone pleas, the Berkeley County Magistrate Court has announced. Individuals who have been issued a citation to appear and/or enter a plea in Berkeley County Magistrate Court, may enter a plea in-person or by completing the back of the citation and mailing or faxing the entire ticket to the courthouse. Individuals are advised to be certain to send both the front and the back of the ticket back to the courthouse.

Do you want a hearing? Request a hearing on citation by entering a plea of not guilty. After the court receives a plea of not guilty, a hearing will be scheduled and the court will mail a notice of the date and time that you are to appear.  

Do you want to pay your fines and costs? If you wish to pay, you may enter a plea of guilty or no contest.  The typical fines and court costs for the most common violations are listed below.  Once the court receives a guilty or no contest plea, it will enter the judgement order and mail a copy to you.  The judgement order will show the amount you owe to satisfy the judgement.  You can then pay by mail, online, or in person.   The court will include instructions on how you can pay with the judgement order.


If an individual does not receive a notice of hearing or a final judgement order within 3 weeks of sending the plea to the court, the individual should contact the courthouse to be certain the plea was received.   A citation is not resolved until an individual either appears at a hearing and/or the individual receives a final judgement order. It is important that individuals provide any corrections necessary to the mailing address on the citation so that the court can send notices and orders to the proper address.

The courthouse is open Monday through Friday (except holidays) from 9:00 AM to 5:00 PM.  The cashier accepts payments in person from 9:00 AM to 4:00 PM.  Online payments (after entering a plea) are accepted 24 hours a day at CourtsWV.gov
