In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:
REQUEST FOR WAIVER: David McCormick: The site is located at 129 McCormick Lane on the north side of Shepherdstown Rd (WV Rt. 45), in the Opequon Tax District. The applicant is requesting a waiver to Section 305.4.1, of the Subdivision Ordinance (2009), requiring WVDOH road frontage, to proceed through the Preliminary/Final plat process. File # 2307-249 tied to 2306-226
REQUEST FOR WAIVER: Nipetown Road Lots: The site is located at the northwest corner of the intersection of T.J. Jackson Drive and Nipetown Road (WV Rt. 8), in the Falling Waters Tax District. The applicant is requesting a waiver to Section 305.4.1, of the Berkeley County Subdivision Ordinance (2009), requiring a 2 acre minimum lot size to proceed through the Preliminary/Final plat process. REQUEST FOR FINAL PLAT APPROVAL: The Reserve at Tuscarora, Section 1, Lots 1-2, 9, 20-37 & 41-45: The site is located along the north side of Tuscarora Pike (WV Rt. 15), approximately 0.5 miles west of Interstate 81, in the Arden Tax District. The final plat proposes 26 single family lots, on approximately 44 acres, to be served by public water and sewer. File # 2304-136
REQUEST FOR FINAL PLAT APPROVAL: The Reserve at Tuscarora, Section 2, Lots 3-8, 10-19 & 38-40: The site is located along the north side of Tuscarora Pike (WV Rt. 15), approximately 0.5 miles west of Interstate 81, in the Arden Tax District. The final plat proposes 19 single family lots, on 29.54 acres, to be served by public water and sewer. File # 2304-137
REQUEST FOR FINAL PLAT APPROVAL: South Brook, Section 2, Phase 1, Lots 160-185 & TH 92-129: The property is located on Shiley Road (CR 34/2); approximately 0.3 miles north of Hatchery Road (CR 11/8), in the Mill Creek Tax District. The final plat proposes 26 single family lots and 38 townhouse lots, on approximately 14.8 acres, to be served by public water and sewer. File # 2304-138
REQUEST FOR FINAL PLAT APPROVAL: Communities of Burwell, Phase 8, Lots E2-E10, D9-D24 & G22: The property is located on Shiley Road (CR 34/2); approximately 0.3 miles north of Hatchery Road (CR 11/8), in the Mill Creek Tax District. The final plat phase proposes 26 single family lots on 9.8 acres, to be served by public water and sewer. File # 2112-442
The PUBLIC HEARING will be held on Monday, August 21, 2023, in the Planning Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known. In the event that an unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date of Tuesday, September 5, 2023 will be utilized.
